Hello all,

My AP had a date of birth error. I mailed the AP and supporting docs back to TSC (along with a check which has already been cashed) 0n Feb 20th and am traveling to India in July.

Any ideas as to how long it takes at TSC to process AP? The USCIS website points to a November 17th processing date for I-131 as of Feb 15th.

Any ideas as to how to speed up the process ?

My current H1 expires on Sept 30. My employer is planning to apply for an extension in the first week of April. Can they file my LCA in advance so that they can have an approved LCA by the first week of April? Or, do they have to wait till Apr 1st (6 months before current H1 expiration) to file for the LCA ? I was not able to find information about this specific scenario.

I was in a similar situation and my lawyer advised to apply for H1 (come April) even without the H4 extension. A query will be sent asking to prove your status until atleast Sep 30th. You can then attach your H4 papers (assuming your H4 extn is approved by then).

Anyway, i am planning to apply for extension using premium processing just to make sure things progress smoothly.

Hi,

I wanted to know that suppose i withdraw my H1 ,
then does it means that my H1 is gone?

And if i want to have H1 again if future (say next year) , will i have to go through the lottery again?

Apologize if this has been already answered, I was just curious after I change jobs using EAD, I just quit and sit idle at home for a while. Is that possible, or on EAD one has to be always working?

My I-140 was denied by TSC early last year. We sent in an MTR/Appeal on the denial. The case was sent over by the TSC to AAO. We received an RFE from the AAO on the appeal a couple of months back. We responded back to the RFE within the required time frame.

My attorney just informed me this week that the case has been transferred back to the USCIS from the AAO. Can anyone please tell me if this means that my case has been approved or denied? Also how long can the USCIS sit on it before adjudicating? I'm assuming that the AAO has passed a decision, thats why they have sent it back to USCIS....

PLEASE HELP!!!

Guys,

Have anybody feeling the big difference between Texas and Nebraska service center processing? Texas is giving greencards and June filers most of them have got EAD and Advanced Paroles. Is immigrationvoice doing anything to escalate the situation.

Please help me with online address change for CA DMV:

My current license expires in May 2010. I moved recently. If I change my address using CA-DMV�s online change of address process, Will I be able to renew my driver license online during renewal time (feb 2010)?

Whats the process for updating the address of the vehicle so that vehicle registration renewal (expected in Jan 2010) comes to the new address?

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. And since then I've noticed that when I do presentations for civic groups or have observed focus groups on immigration, the older attendees seem to be more hostile. One can contiue to stay using I-485 receipt without valid I-94. afasik I-797 can be used only if you filed H1 extention after you came back on parolee.

If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.

In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

I do not foresee any problem in using your current AP, if your travel time is well within it's period.
