    Gurus..I need some help

    My I-140 is approved. I recently got 3 year extension and I am in my 7th year currently.
    I may get a better offer. My question is
    1. Since I have a new H1b which is valid for 3 years (for H1b year 7,8 and 9), can I transfer it to a new employer?
    2. Also, the new employer is willing to file GC, can I use my old PD date. (the new job profile is similar)
    3. If the current employer withdraws my I-140, will that affect my H1 transfer?

    Please help.

    Since this is not criminal in nature, I dont think u will have much of an issue. But just for ur peace of mind, why dont u just call ur immigration lawyer and ask, i mean if u have one

    Last month dates were 7 Jan 2005.
    This month dates are 22 Jan 2005.
    Still the reported Jan 2005 approvals(, IV ) etc are less than 5.
    Not sure whats happening to these

    I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

    Does anyone know whats going at Mumbai Consulate ? They generally publish the list of Consular Processing (CP) Interviews by 15th and this time no news. Delhi and Chennai have come up with their lists.

    Hello
    I am working on H1 and my current H1 petition is valid until April 6th 2011.
    My visa (stamp) expired in Nov 2009.
    I have my new H1 extension petition approved from April 7th 2011- 2014( same employer).
    I am going to India early Feb and will going to Hyd/Chennai for visa stamp.
    In the visa appointment it is asking for my petition number: which one should I give current or the new extension one. I would like to have my H1 stamped until 2014 so that I can avoid additional trip to consulate.
    Please help.

    I am in a unique situation. I have filed for my H1B through company A and pretty recently got a 3 year extension too. I also have an approved Labor and I-140 through them. This May the company had an asset only aquisition and is now operating under a new name and Employee ID. Since we are all open to file our I-485 I contacted my immigration lawyer and explained the company reorganization. At first the lawyer was claiming that we should file an Amended I-140 due to the reorg. My company lawyer informed my Immigration Lawyer that the new company has not taken over the liabilities of the old company, it only took over the assets. Now my immigration lawyer claims that I will have to transfer my H1B to the new company and move forward with my original I-485 application and then port after 180 days. I wanted to get a second opinion from someone on this board.

    For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications.     That requirement is only for foreign passport holders travelling on visa/or visa waiver.

    Us citizens are required tp present a non-expired passport, it does not say how long the passport needs to be valid for

    We can see more of these GC approvals and visa number allocation in September because USCIS and DOS have to use up all available visa numbers.

    If not, we can see again about 10,000 visa numbers unused and wasted.
