My PD for the EB-2 application is December 2005 BUT I filed my 485 in August 2008 so I am wondering if the US CIS will work on my 485 once my PD is current or will they wait for the PD and the 485 filing date to be current?

My H1 is expired and i am working in EAD now. I am going for vacation next week. I dont have valid I94 (as my H1 is expired, my I94 also expired), does it cause any problem when i reentry?
Does immigration give new I94 when we enter with AP? I appreciate your help.

Hi,
My PD is Dec-04 and I-485 filing date is Sept-07.
I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!

AC21 is the only light at the end of the tunnel for doing such things. If you change employer before I-485 is filed and pending 180 days, all you will get will be your labor priority date. You will have to file labor and I-140 again with your new employer and when filing I-485 you can use your old priority date.

As far as the jury is concerned, however, the case is about only one thing: lying.
One particularly well-qualified witness on this subject was not called by either the prosecution or the defense, so today we cross-examine Robert Feldman ourselves. Feldman is a social psychologist at the University of Massachusetts who studies lying in everyday life, and his findings are just the kind of thing that Libby's lawyers could have pounced on.
Feldman's experiments show that stern-faced judicial proceedings about perjury are as remote from the realities of human behavior as President Bush is from the Nobel Peace Prize. For one thing, lying plays a more complex role in human relationships than the black-and-white legal view recognizes. It is also so commonplace in everyday life that putting people on trial for lying is somewhat like putting them on trial for breathing.
Experiments have found that ordinary people tell about two lies every 10 minutes, with some people getting in as many as a dozen falsehoods in that period. All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.
Last time I travelled out of US was back in May 2001 for couple of weeks.
Now got this RFE any idea what do I need to submit.

My wife has a valid H4 visa and she's currently in India as her company is applying for a fresh H1B visa for her. I'm currently in US on valid H1B visa till 7-Dec-2011.(Her H4 will also expire on the same date)
Qs: After getting the recipt for H1B application, can she travel on her H4 visa or does she have to wait till the approval\rejection of H1B?
Please note that this is not a case of H4 to H1 transfer.

First check if the check you or your company sent for H-1 fees got cashed , if so see behind the check ( normally banks post scanned copy of check ) the Receipt number will be written behind the check ..hope this helps

I am planning to schedule a H1/H4 stamping visa appointment for next month. Here are few questions regarding the vfs web site.
The date I am planning to schedule is still not showing as available. My question
is can I enter all my data and save it and once the date shows up, can I select
the date? How does it work? If not do I need to enter all the data on the day
when it opens up?

Do not expect any approval from NSC today....we can only expect automatic uptdates!

I am EB3 and recently got my h1-b extension from 10th to 13 year and got approved without any RFE in 2months from VSC.approved in 3rd week of january.i am working for the same company since 2002 an I am permanent employee not consultant and no clients
Now all the sudden out of nowhere an immigration inspector came to our workplace and asked details about my work, salary. They didn't ask anything else. They asked about me but I was working from home that day an per hr its related to h1-b but they have no clue as i am the only one non immigrant in 1600 employees
Is this common?
Should I enquiry with uscis? If so how
Since I worked from home that day and didn�t meet me, will there be an issue?
Should I be concerned anything or just forget about it. Any of your experiences thoughts are much advised
