Trying to use my EB3 date in the EB2 category
Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one
I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

Current Status: Notice returned as undeliverable.
On May 14, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.
I have not moved in 2 years and have been receiving notices, EAD cards etc. at this address. I called Uscis and gave them my address again.
Has this happened to anyone before? How long has it taken to resolve the situation. Did you contact your local post office?

Desi employer is not paying for the PTO that I used about 4 months ago. since I'm leaving them in about 2 weeks, they've been delaying this and not paid my PTO. I sent 200+ emails to them.,
I have emails from Employee rerlations managers of the company confirming my available hours and telling me that I would be paid. then endless chains of emails....
I intend to take them to court over this issue. Just wondering if emails in this regard would be sufficient proof of my eligibility and their reluctance for paying my PTO. Is PTO treated same as salary?
I actually went on vacation after confirming with HR that I had PTO in my account. Even after coming back I got emaisl from them that I'll be paid..
Nothing yet after 4 months.
Any suggestions on how to take legal help on this. I've been workign for them for the last 4.5 years.

in IE, a "X" appears next to the "Image Verification" field, indicating the image cannot be displayed.

Hi,
I am currently with Wipro. I was working in india and i came onsite thorugh Wipro itself on H1B . Right now i have couple of offers with other companies and i would like to resign wirpo. When i want to resign wipro asks me to pay 5 lakhs + H1B change ($2000) . Can you please let me know how to proceed with this ? The reason why they are asking me to pay 5 lakhs is they want me to come back to india and work for 6 months(which does not make sense) when i have couple of offers here .
Is it legal for companies to charge this much of money ?
Has anyone from wipro come onsite and resigned here ?

Have we taken in to account these action items
1) Improve Overall GC Process time.
2) Re-use all unused visa's that went in vain in past
3) Count each family as one visa instead of each for each family member.
And What do we need to do as a member of IV to lobby these changes.

My I-140 got approved and priority date from EB3 got ported to EB2. I read in one of the forum threads that USCIS system would automatically identify that application is current and appropriate action will be taken. Also, I read about initiating interfile process of existing EB2 I-140 (current) with Pending I-485 application (under EB3). I am not sure whether I should wait few weeks before initiating interfile process.
I have given my biometrics in 2007 while filing I-485. Will USCIS send appointment for Biometrics again ?

Hi I am currently working as a contractor at a client from company C1
C1 applied for my H1B last year and application is still pending + also added Premium Proc. last week, Application Still Pending
At the same time company C2 applied my H1B last year and H1B approved but did not get the documents from USCIS, and applied for "Response on Approved Petition", That is still pennding(But Yes The petition is approved)
But Fortunately or Unfortunately , I got a permananent job with a new company.
I can start working with that company on OPT, and he will apply a new H1B this year.
But , Instead of that Can I get one of my H1Bs transferred?
Or is there a better way to handle this situation?
I know its a mess... Can some one suggest me how to clear this mess?
